Utenriksminister Mike Pompeo varsler at USA går bort fra en tolkning fra 1978 som anser bosettingene på Vestbredden for å være ulovlige. Bosettingene er ikke nødvendigvis i strid med folkeretten, sier Pompeo.

Det åpner helt nye perspektiver for løsninger.

“This policy reflects an historical truth – that the Jewish people are not foreign colonialists in Judea and Samaria,” it said, using the Israeli terms for the West Bank.

Det er et vesentlig linjeskift fra Trump-administrasjonen, og føyer seg inn i rekken av vedtak som styrker Israels rett til landet.

“After carefully studying all sides of the legal debate,” Pompeo told reporters, the United States has concluded that “the establishment of Israeli civilian settlements in the West Bank is not, per se, inconsistent with international law.”

“Calling the establishment of civilian settlements inconsistent with international law hasn’t worked. It hasn’t advanced the cause of peace,” Pompeo said.

“The hard truth is that there will never be a judicial resolution to the conflict, and arguments about who is right and who is wrong as a matter of international law will not bring peace.”

USA har anerkjent Golan som israelsk og flyttet ambassaden til Jerusalem, dvs anerkjent Jerusalem som Israels hovedstad. Ved å åpne for at bosettingene på Vestbredden er lovlige, åpner USA for at kortene kan legges på nytt. Status er ikke frosset.

Benjamin Netanyahu hilste erklæringen velkommen:

“This policy reflects a historical truth — that the Jewish people are not foreign colonialists in Judea and Samaria,” Netanyahu said in a statement, referring referring to the West Bank by its biblical name.

USA overlater til israelske domstoler å fatte beslutninger om lovligheten av de enkelte bosettinger.

Netanyahu lauded Pompeo’s pronouncement that the US would defer to Israel’s courts to determine the legality of settlements.

“Israel’s legal system, which has proven itself fully capable of addressing legal questions related to the settlements, is the appropriate place for these matters to be adjudicated — not biased international forums that pay no attention to history or facts,” he said.

“Israel remains ready and willing to conduct peace negotiations with the Palestinians regarding all final status issues in an effort to achieve a durable peace, but will continue to reject all arguments regarding the illegality of the settlements,” he said.
